Terms of service

These terms apply when you use this website, request a quote from us or buy from us. “We”, “us” and “our” mean Kontact Pty Ltd (ABN 47 640 373 459), trading as Kontact Medical. “You” means the person using the website, or the business or organisation you order for.

Please read them with our Privacy policy, Delivery policy and Returns and refunds policy, which form part of these terms. By using the website or placing an order, you agree to these terms.

1. Your rights under the Australian Consumer Law

Nothing in these terms excludes, restricts or changes any right or remedy, or any guarantee, warranty or other term or condition, that the Australian Consumer Law or any other law gives you and that cannot lawfully be excluded or limited.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

2. Using the website and your account

• The information you give us, including your contact, delivery and billing details, must be correct and up to date.
• You are responsible for keeping your account login secure and for activity on your account. Tell us straight away if you think someone else has used it.
• If you order or request a quote for a business or organisation, you confirm that you are authorised to do so on its behalf.
• You must be 18 or over to place an order.

3. Products, specifications and images

• Product pages show the manufacturer’s published specifications. Where a figure isn’t confirmed, the page says so. Manufacturers can change a design or specification without notice; if a change matters to you, ask us to confirm it before you order.
• Product images show the product as supplied by the manufacturer. Colours can look different on your screen. Room photos on the website are illustrative and do not show our premises, staff or customers.
• You are responsible for checking that equipment suits your intended use, space and access (including doorways, lifts and stairs), and for using it as the manufacturer instructs, by trained staff where that is required.
• We may discontinue a product or limit the quantity we supply.

4. Prices and GST

• Prices are in Australian dollars and include GST.
• Delivery is shown separately, priced to your postcode before you pay. See Delivery.
• Prices can change without notice. The price that applies is the one shown when you place your order, or the price in a quote we have issued to you.
• If a price or other detail on the website is clearly wrong, we will contact you before we process your order. You can then go ahead at the correct price or cancel, and we will refund anything you have paid.

5. Quotes

• A quote request is not an order. When you send one, we reply by email with a quote for the items and delivery to your postcode.
• Where a quote states how long it is valid, its prices hold for that period. Otherwise prices and availability may change before you accept it, and we will tell you if they have.
• An order is made from a quote only when you accept the quote and we confirm the order.

6. Orders and payment

• When you place an order you make an offer to buy. The order is accepted when we confirm it to you by email.
• We may decline or cancel an order, for example if a product is unavailable, the price is wrong or we can’t deliver to the address. If we do, we will tell you and refund anything you have paid in full.
• You must pay the full price, including delivery, using a payment method we offer at checkout or on your quote.
• If you want to change or cancel an order after we have confirmed it, contact us as soon as possible. Items that have already been dispatched, or ordered in specially for you, may not be able to be cancelled.

7. Delivery, risk and ownership

• Delivery is covered by our Delivery policy and Delivery page. Delivery times are estimates.
• Deliveries require a signature. Please check the goods when they arrive and note any visible damage on the delivery paperwork, then tell us as soon as possible.
• Risk in the goods passes to you when they are delivered. Ownership passes to you when we have received full payment.

8. Returns, faulty goods and warranty

• Change-of-mind returns are covered by our Returns and refunds policy.
• If goods arrive faulty, damaged or not as ordered, contact us. Your rights under the Australian Consumer Law (section 1) always apply.
• Some products also come with a manufacturer’s warranty. Where they do, the product page or the paperwork supplied with the product gives the details. A manufacturer’s warranty is in addition to your rights under the Australian Consumer Law.

9. Limits on our liability

This section is subject to section 1.

• Where goods or services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for a failure to comply with a consumer guarantee is limited, as far as the law allows and at our choice, to replacing or repairing the goods (or paying the cost of doing so), or supplying the services again (or paying the cost of doing so).
• As far as the law allows, we are not liable for any indirect or consequential loss, such as loss of profit, revenue or business opportunity.
• We are not liable for loss caused by your failure to follow the manufacturer’s instructions, or by events outside our reasonable control.

10. Website content and intellectual property

• The content and design of this website belong to us or our licensors. You may use the website to research and buy products, and print or save pages and spec sheets for that purpose. You must not otherwise copy, republish or sell the content without our written permission.
• Brand names, logos and product names belong to their owners. Manufacturer specifications and documents remain the property of the manufacturer.

11. Acceptable use

You must not use the website for anything unlawful or misleading, to harass or harm anyone, to send spam, to upload malicious code, to collect other people’s personal information, to scrape or crawl it in a way that affects its operation, or to interfere with its security. We may suspend or close an account that breaks these rules.

12. Other websites

The website may link to other websites, such as manufacturers’ sites. We don’t control them and are not responsible for their content. Their own terms and privacy policies apply.

13. Errors on the website

We work to keep the website accurate, but it may occasionally contain errors in descriptions, prices, delivery charges or availability. We may correct them at any time. Where an error affects an order you have placed, section 4 applies.

14. Privacy

We handle your personal information in line with our Privacy policy.

15. Changes to these terms

We may update these terms by publishing a new version on this page. The terms that apply to an order are the ones published when you placed it.

16. Governing law

These terms are governed by the law of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria.
